Terms of Service
Applies to will.co.zw and the services described below.
Draft — pending legal review. This document is a working draft prepared for transparency. It has not yet been settled by our legal practitioners, and its terms may change. Where a point is commercially or legally significant, it is marked as subject to confirmation.
1. What this service is
Will.co.zw is a guided drafting service. It asks you structured questions and uses your answers to prepare estate-planning documents — a will, a joint will, a living family trust deed, a power of attorney or a healthcare directive.
Using the platform is not the same as receiving legal advice. The guidance in the interview is general information. Where your circumstances are complex or contested, you should obtain advice from a legal practitioner. You can flag a question for the Legal Partner within the service.
2. Who you are contracting with
Two organisations are involved. Talent Africa Inc. provides and operates the platform and handles diaspora billing by card. DRT, a firm of legal practitioners, provides the legal services layer and handles billing within Zimbabwe through Paynow.
Which entity you contract with for a given service depends on where you are billed and what you have bought. The precise allocation of obligations between the two entities is subject to confirmation in the final terms.
3. Documents are drafts until you sign them
Every document produced by the platform is a draft with no legal effect until it is printed and properly executed.
- A will must be printed and signed by you in the presence of two competent witnesses, who must also sign. Witnesses should not be beneficiaries.
- A trust deed must be notarially executed.
- Zimbabwe does not recognise electronic wills. Nothing on this platform is signed electronically, and no click, tick box or stored file substitutes for a signed paper original.
You are responsible for executing your documents correctly and for keeping the signed originals safe and findable.
4. Revisions and amendment fees
Once a plan has been paid for and its documents generated, further changes are made through a paid amendment. Paying the amendment fee reopens the plan for editing; it does not itself produce a new document. When you finalise the amendment we generate a replacement document and mark the previous version as replaced.
Your previously signed document remains the operative document until you print and properly execute the replacement. Amendment fees are shown before you pay and are subject to change.
5. Payment and refunds
Prices are displayed before purchase. Diaspora payments are processed by card through Stripe; Zimbabwean payments are processed through Paynow. Access to document generation follows confirmation of payment by the payment provider.
Refund terms are subject to confirmation. Pending final terms, we will deal with refund requests reasonably and case by case; contact us before disputing a charge.
6. Your responsibilities
The documents we produce reflect the answers you give. You are responsible for the accuracy and completeness of the information you enter — names, identity details, relationships, assets, and shares — and for reviewing the generated document before signing it. You must keep your account credentials confidential and must not use the service to defraud any person or to defeat the rights of a dependant.
7. Limitation of liability
To the maximum extent permitted by law, our liability arising from your use of the platform is limited to the amounts you paid for the service in question. We are not liable for loss arising from documents that were never signed, were signed incorrectly, were revoked, or were prepared from inaccurate information supplied by you. Nothing in these terms limits liability that cannot lawfully be limited, including for fraud, and nothing limits the professional obligations of the legal practitioners where legal services are actually rendered to you.
The final wording of this clause is subject to legal review.
8. Accounts and termination
You may close your account at any time. We may suspend or terminate an account for non-payment, misuse of the platform, or unlawful activity. Where an account is closed, we will make your generated documents available to you before deletion, subject to any record-retention obligations that apply to the legal practice.
9. Governing law
These terms are governed by the laws of Zimbabwe, and the Zimbabwean courts have jurisdiction over any dispute arising from them.
